What Is Beckham Law in Spain?

The reality is more complicated. Beckham Law can be very valuable for some people, but it is not automatic and it does not apply to every Digital Nomad Visa holder or every autónomo.

How Does Beckham Law Work?

Under the normal Spanish tax system, tax residents are generally taxed on worldwide income using progressive tax rates.

Under Beckham Law, qualifying individuals may be taxed under special rules that resemble non-resident taxation.

The headline benefit is the well-known 24% rate on qualifying income up to €600,000. Income above that amount may be taxed at a higher rate.

  • Automatically pay 24% tax

That is not how it works.

The Digital Nomad Visa and Beckham Law are separate questions. The visa is an immigration status. Beckham Law is a tax regime.

You can have a Digital Nomad Visa and still fail to qualify for Beckham Law.

Can Digital Nomad Visa Holders Use Beckham Law?

Often, yes.

One of the important changes introduced by Spain's Startup Law was the expansion of the special regime beyond traditional employees. This opened the door for many international remote workers and Digital Nomad Visa holders.

But this does not mean every Digital Nomad Visa holder automatically qualifies.

Can Autónomos Use Beckham Law?

Some websites say autónomos can use Beckham Law. Others say they cannot. Both statements are too simple.

The reform expanded the regime to include certain entrepreneurs, highly qualified professionals and specific professional activities.

However, this does not mean that every traditional autónomo automatically qualifies.

A person who simply registers as an autónomo and invoices several clients should not assume Beckham Law applies automatically.

The key question is not only:

"Are you an autónomo?"

The more important question is:

"Under which legal category are you applying?"

Why Do So Many People Get Confused?

Because three different concepts are often mixed together:

Digital Nomad Visa

Autónomo

This is a tax and Social Security registration status for self-employed activity in Spain.

Beckham Law

This is a special tax regime. It answers the question: how will qualifying income be taxed after you move to Spain?

These three concepts can overlap, but they are not the same thing.

The 5-Year Rule

One of the most important requirements is the tax residency rule.

In general, you must not have been a Spanish tax resident during the five tax years before moving to Spain.

If you were already a Spanish tax resident recently, Beckham Law may not be available.

The 6-Month Deadline

Another common mistake is missing the application deadline.

The special regime is generally requested through Modelo 149 after starting the qualifying activity in Spain.

Missing the deadline can be expensive because it may prevent you from using the regime even if you would otherwise qualify.

Modelo 149 and Modelo 151

Two forms are especially important for Beckham Law:

  • Modelo 149 - used to notify or request the application of the special regime.
  • Modelo 151 - the annual tax return used by taxpayers under the regime.

This is different from the standard quarterly autónomo filing system. For regular autónomos, quarterly obligations may include Modelo 130 and Modelo 303.

How Much Can You Save?
